Section 16
Auctioning of land
(1) From the land that is left over as shown in the survey according to section 14, the remaining portion of the land for collection of land can be sold by auction as determined by the Land Land Office.
(2) If the land will be auctioned according to this section, such auction sale will be started from the month of November.
(3) In the event of auction sale according to sub-section (1), if no one accepts, the ownership of such land shall be transferred to the Government of Nepal and the land owned by the Government of Nepal may be sold and distributed as prescribed. But even if the ownership of such land is transferred to the government of Nepal, the Mohiyani rights of the land will remain intact.
(4) Sub-section (1) of the proceeds from the auction sale, the remainder of the property and fifty percent of the fee shall be returned to the respective landowners.
(5) According to sub-section (3) the land owned by the Government of Nepal shall be maintained and other arrangements shall be as prescribed until the land is sold and distributed.
(6) Notwithstanding anything written in this section, if the property is filed from the 16th of Ashadh until the land is auctioned, the property office will collect the property from the owner of the property by charging an annual fee of ten percent of the property. However, thirty-five percent duty will be levied on the remaining goods before the commencement of this sub-section.
(2) If the land will be auctioned according to this section, such auction sale will be started from the month of November.
(3) In the event of auction sale according to sub-section (1), if no one accepts, the ownership of such land shall be transferred to the Government of Nepal and the land owned by the Government of Nepal may be sold and distributed as prescribed. But even if the ownership of such land is transferred to the government of Nepal, the Mohiyani rights of the land will remain intact.
